Ensuring Validity of Collaborative Settlement Agreements in a Non-Collaborative World – Practice Tips about Disclosure, Negotiation, and Drafting

As many practitioners know, Collaborative law exists in a world that is not always collaborative.

This program will provide insight into practical and creative ways to help reinforce the validity of Collaborative settlements and protect clients (and counsel) for the long-term following a Collaborative case.

The program will first discuss disclosure requirements under the UCLA and how they intersect with other Virginia laws concerning the validity of marital settlement agreements. The program will then identify problems that may arise within the team, which may later undermine the validity of Collaborative settlement, and will offer tips and strategies for resolving and avoiding the same.

Lastly, the program will look at terms and practices that will help reinforce the validity of Collaborative settlements from within the settlement document, in the event of later scrutiny by the parties or the Court.

This program will give both lawyers and non-lawyers more awareness and tools to ensure success in their Collaborative practice.
